The Royal Institute of British Architects (RIBA) and the Architects Registration Board (ARB) require members to have this type of cover. The ARB actually has minimum requirements for professional indemnity insurance, which their members must follow. These are as follows:

• Policy Wording. This must be on a civil liability basis and not on a neglect, error or omission basis, which is not wide enough
• Limit of Indemnity. This must be on any one claim basis, unlimited in any one period
• Excesses must be affordable
• Legal defence costs must be in addition to the limit of indemnity
• Members of the ARB must maintain cover for at least six years after ceasing to trade.
• Minimum levels of cover required by the ARB are as follows:

Fee income less than £100,000 – Limit of Indemnity required : £250,000
- Fee income between £100,000 & £200,000 – Limit of Indemnity required : £500,000
- Fee income exceeding £200,000 – Limit of Indemnity required : £1,000,000

If your current professional indemnity insurance has not been issued on the above basis then you have the wrong type of policy and are therefore not complying with the ARB rules.
